Terms of Service

1. Acceptance of Terms

By accessing or using RoleFresh ("the Service," "the Platform," "we," "our," or "us"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. Your use of the Service constitutes your acceptance of these Terms, and this agreement is as valid and enforceable as a written contract signed by you.

2. Nature of Service — Experimental, At Your Own Risk

THE SERVICE IS PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "AT YOUR OWN RISK" BASIS. RoleFresh is an experimental, AI-powered job search assistance platform. The Service includes, but is not limited to, automated job matching, AI-generated resume variants, automated form-filling and submission, a Chrome extension that interacts with third-party websites, networking outreach tools, and related features.

All features are experimental in nature. We make no guarantees that any feature will function as described, produce desired results, or remain available. Features may be modified, degraded, or discontinued at any time without notice.

We are building tools to help job seekers. Our intent is solely to assist you in your job search. We do not intend harm to any user, employer, job platform, or third party. However, you acknowledge that the use of automation tools in the job application process is inherently unpredictable and may produce outcomes we did not foresee or intend.

This is an at-your-own-risk platform. By using it, you accept full responsibility for all outcomes, whether intended or unintended, positive or negative.

3. Assumption of Risk — You Bear All Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE AND EXCLUSIVE RISK. You are voluntarily choosing to use the Service. We do not require, compel, or mandate that you use any feature of the Platform. Creating an account and using the Service is entirely your choice. You bear all risk associated with your use of the Service, without limitation and without exception.

Specifically, you understand and accept the following risks:

• Application outcomes: We cannot guarantee that any job application submitted through or with the assistance of the Service will result in interviews, offers, or employment. Automated applications may be rejected, flagged, or blacklisted by employers or job platforms. This risk is entirely yours.
• Third-party platform policies: The Service interacts with third-party websites and platforms (including but not limited to LinkedIn, Indeed, Greenhouse, Lever, and others). These platforms may have terms of service that prohibit automated access, scraping, or automated application submission. You are solely responsible for ensuring your use of the Service complies with the terms of any third-party platform. Any violation of third-party terms is your responsibility, not ours.
• Chrome extension risks: The RoleFresh Chrome extension interacts with third-party websites by reading page content and filling forms. This functionality depends on the structure of third-party websites, which can change without notice. The extension may malfunction, fill incorrect data, or cause unexpected behavior on third-party sites. You are responsible for reviewing all data before submission. Any errors in submitted data are your responsibility.
• AI-generated content: Resume variants, cover letters, outreach messages, and other content generated by the Service are produced by artificial intelligence and may contain inaccuracies, fabrications, or content that does not accurately represent your experience or qualifications. You are solely responsible for reviewing, editing, and approving all AI-generated content before it is submitted to any third party. Any harm resulting from unverified AI content is your responsibility.
• Data accuracy: Job listings, company information, and other data aggregated by the Service may be incomplete, outdated, or inaccurate. We do not verify the accuracy of third-party data. Any decisions you make based on unverified data are your responsibility.
• Account consequences: Use of automated tools may result in your account being flagged, restricted, or banned on third-party job platforms. We are not responsible for any such consequences. You accept this risk by using the Service.
• Unintended outcomes: Even when used as intended, the Service may produce outcomes that are harmful to your job search, professional reputation, or relationships with employers or platforms. We did not require you to use the Service. You chose to use it. You own the outcomes.

4. Limitation of Liability — No Financial Exposure

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROLEFRESH, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES OF ANY KIND, including but not limited to:

• Loss of employment opportunities, job offers, or interviews
• Being flagged, restricted, suspended, or banned by any job platform, employer, or third party
• Damage to your professional reputation or career prospects
• Loss of data, corruption of data, or unauthorized access to your data
• Errors, inaccuracies, or fabrications in AI-generated content that you submitted
• Any actions taken by third parties (employers, recruiters, job platforms, government agencies) in connection with applications submitted through the Service
• Business losses, lost income, lost wages, or lost opportunities of any kind
• Emotional distress, mental anguish, or psychological harm arising from job search outcomes
• Legal claims brought against you by third parties as a result of your use of the Service
• Any other losses or damages of any nature whatsoever, whether foreseeable or unforeseeable

IN NO EVENT SHALL ROLEFRESH'S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED ZERO DOLLARS ($0.00). You acknowledge that you use the Service at your own risk and that we shall have no financial liability to you or any third party for any reason whatsoever.

If the foregoing limitation is found to be unenforceable, our total liability shall not exceed one US dollar ($1.00). You acknowledge that this limitation reflects the at-your-own-risk nature of the Service and is a fundamental element of the bargain between you and RoleFresh.

5. Indemnification

You agree to indemnify, defend, and hold harmless RoleFresh, its owners, operators, employees, agents, affiliates, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and legal costs) arising out of or related to: (a) your use of the Service; (b) any content you submit, transmit, or make available through the Service; (c) your violation of these Terms; (d) your violation of any third-party right, including any intellectual property, privacy, or contractual right; (e) any dispute between you and any employer, recruiter, job platform, or other third party arising from your use of the Service; (f) any claim that your use of the Service caused damage to a third party; or (g) any legal action taken against you as a result of applications submitted through the Service. This indemnification obligation is unlimited in scope and amount.

6. No Warranty

THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any information, content, or results obtained through the Service.

7. User Responsibilities

You are solely and fully responsible for:

• All content you provide, including resume data, personal information, and application materials
• Reviewing and approving all AI-generated content before submission to any third party
• Reviewing all auto-filled form data before submitting any application
• Ensuring your use of the Service complies with all applicable laws, regulations, and third-party terms of service
• Maintaining the security and confidentiality of your account credentials
• All activity that occurs under your account
• Any consequences that arise from your use of the Service, including but not limited to application rejections, account restrictions on third-party platforms, or disputes with employers

8. Prohibited Uses

You agree not to use the Service to:

• Submit false, misleading, or fraudulent information to any employer or job platform
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Violate any applicable law, regulation, or third-party terms of service
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to any part of the Service or other users' accounts
• Use the Service for any purpose other than your own personal job search
• Resell, redistribute, or commercially exploit the Service without our written consent

9. Intellectual Property

You retain ownership of all content you provide to the Service (your resume data, personal information, etc.). By using the Service, you grant us a limited, non-exclusive license to process your data solely for the purpose of providing the Service. We retain all rights to the Service itself, including its design, code, algorithms, and AI models. AI-generated content created specifically for you is yours to use, but we make no claim that such content is original or does not resemble content generated for other users.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection, storage, and processing of your data as described in the Privacy Policy. You acknowledge that the Service uses third-party AI providers (such as OpenRouter) to generate content, and your data may be processed by these providers subject to their own terms and policies.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We will update the "Last updated" date at the top of this page. It is your responsibility to review these Terms periodically.

12. Termination

We may suspend or terminate your access to the Service at any time, for any reason, with or without notice. You may terminate your account at any time by deleting it from your account settings. Upon termination, your right to use the Service ceases immediately. Sections 4 (Limitation of Liability), 5 (Indemnification), and 6 (No Warranty) shall survive termination.

13. Dispute Resolution

Any dispute arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in the State of Delaware. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and RoleFresh regarding the Service and supersede all prior agreements, understandings, and representations.
